These Terms of Service (“Terms,” “Agreement,” or “User Agreement”) govern your access to and use of Gandy Ink’s website, products, services, and custom designs. By placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms. If you disagree, you may not use our services.

Orders, Pricing, and Payments

• All-Inclusive Pricing: Our pricing includes artwork, setup, digitizing, and standard ground shipping. Additional services (such as expedited shipping) may incur extra charges.
• Payment Terms: Orders must be paid per the payment terms provided at checkout or agreed upon in writing.
• Discounts: Gandy Ink may offer planned discounts throughout the year (e.g., January, June, July). Discounts cannot be combined unless expressly stated.

Shipping and Delivery

• Fast Turnaround: Many stock items qualify for next-day shipping. Expedited services may require additional fees.
• Delivery Timeline: We make every effort to meet promised delivery dates, but cannot be held responsible for delays due to carriers, weather, or events beyond our control.
• Risk of Loss: Title and risk of loss pass to you upon delivery to the shipping carrier.

Custom Artwork and Designs

• Customer Submissions: By submitting artwork, logos, or designs, you represent that you own or have the right to use such content. You grant Gandy Ink a non-exclusive, royalty-free license to reproduce and use submitted content to fulfill your order.
• Stock Designs: Gandy Ink provides stock designs that may be customized for your organization. Gandy Ink retains ownership of these designs.
• Color Variations: Minor variations in color or appearance may occur due to screen displays, fabric differences, or print methods. Such variations are not considered defects.

User Conduct and Prohibited Uses

You agree not to:

• Submit infringing, obscene, defamatory, or unlawful content.
• Interfere with or disrupt our website, services, or operations.

Intellectual Property Rights

• All Gandy Ink trademarks, logos, product names, and stock designs remain the exclusive property of Gandy Ink.
• You may not use our intellectual property without prior written permission.

Disclaimers

• Services are provided “as-is” and “as available.”
• Gandy Ink makes no warranties, express or implied, regarding uninterrupted access, error-free production, or the fact that finished products will exactly match digital mockups.

Limitation of Liability

To the maximum extent permitted by law, Gandy Ink and its affiliates will not be liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim shall not exceed the total amount you paid for the order giving rise to the claim.

Indemnification

You agree to indemnify and hold Gandy Ink, its employees, and affiliates harmless from any claims, damages, or expenses arising from your submitted artwork, misuse of our services, or violation of these Terms.

Termination

We may suspend or terminate your access to services at any time for violations of these Terms. Certain provisions (e.g., Intellectual Property, Limitation of Liability, Indemnification) will survive termination.

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised “Effective Date.” Continued use of our services constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.
